The real problem

The safety binder is from 2019.

Do we need a guard on a 1980s shaper?
Yes — under Part 12, Section 12.22. Point-of-operation guards are required for all woodworking machinery regardless of age. Three things to check: (1) guard covers the cutting area, (2) infeed has anti-kickback, (3) emergency stop within reach.
What about fall protection at 2.8 metres?
Below the 3-metre threshold in Section 11.2 — but Part 4 general duty still applies. If there's risk of injury from falling, you need a written fall protection plan and guardrails or a harness.
